Important Notice: CC&R Amendment Vote – December 2-20, 2024

We are reaching out to all property owners in The Estates at Eagle Creek to inform you of an important CC&R (Covenants, Conditions, and Restrictions) Amendment Vote taking place between December 2 and December 20, 2024. This vote will require the participation of at least 2/3 of the property owners in order to be valid, so your participation is essential.

 

What’s Being Voted On?
This vote will address both the consolidation of the CC&Rs for all four sections of The Estates at Eagle Creek and proposed changes to specific provisions within the CC&Rs. The following is an overview of the key items:

   

   1. CC&R Consolidation:
   The Board proposes adopting the CC&Rs from Section 2 as the unified CC&Rs for the entire Estates at Eagle Creek. This change will streamline administration, save on filing fees, and simplify any future amendments. Please note that if this consolidation item fails, the entire vote will be invalid.

 

   2. Proposed Changes to the CC&Rs:
         Section 2.05 Bridle Paths
         Section 3.01 Single Family Residential Construction
         Section 3.05 Walls and Fences
         Section 3.07 Garbage and Trash Disposal
         Section 3.08 Junked Motor Vehicles Prohibited
         Section 3.10 Animal Husbandry
(Including a provision to allow chickens)
         Section 6.02 Basis of the Maintenance Charge
         Section 6.05 Notice of Lien

 

The ballot will feature two columns:  
     Left column: Current CC&R provisions  
     Right column: Proposed changes  


At the top of each section, there will be **two boxes** to vote For or Against each proposed change.

Why Are We Voting?
The proposed changes address gray areas, outdated provisions, and state law updates that have been problematic for both the ACC and Board of Directors, as well as feedback gathered from a recent property owner survey. This vote is designed to bring more clarity, provide better definition, and ensure the CC&Rs are aligned with current laws.

 

How to Vote:
   If you have a current email on file with the POA, you will receive a ballot link via email, which you can complete and submit online.
   A shortcut link will also be available on this website for easy access.
   If you own more than one lot, you will only need to vote once.
   If we don’t have your email on file, a paper ballot will be mailed to you, and a volunteer will follow up with a phone call to confirm receipt.
   Paper Ballots: If you prefer a paper ballot, you can pick one up at the designated location, or request one to be mailed to you.

 

Special Ballot Pickup Location:
We are seeking permission to place an Outdoor Real Estate Brochure Box at the Wilson County District 2 Emergency Services Larry D. Phillips Station 1 for ballot pickup. We will also have notifications at all the entrances to remind neighbors to participate.

Ballot Processing and Tallying:
Ballots will be verified against the current property owners list and tallied by resident volunteers who assisted with the survey and ballot preparation.  

Spread the Word!
Please help us ensure that every property owner has the opportunity to vote. Tell your neighbors!  We will be posting notices at all community entrances, and volunteers will be available to assist with any questions.

The Estates At Eagle Creek is a deed restricted community located approximately 15 miles south of San Antonio, Texas in unincorporated Wilson County. The residences are protected by a property owners association called “The Estates at Eagle Creek Property Owners Association”.
